Airtime Service Terms and Conditions

These Terms and Conditions apply to all satellite airtime services supplied by Satellite Phone Warehouse (ABN 60 505 154 305) ("Satellite Phone Warehouse", "we", "us" or "our").

By signing an Airtime Service Agreement, requesting activation of an airtime service, or using an airtime service supplied by us, you agree to be bound by these Terms and Conditions.

1. Service Activation

1.1 Airtime services will be activated following receipt of a completed Airtime Service Agreement and any information reasonably required by us.

1.2 Service activation is subject to approval by the relevant satellite network provider.

1.3 Activation dates are estimates only and may vary due to circumstances outside our control.

1.4 We reserve the right to refuse or cancel an application where required by the network provider or where payment arrangements cannot be verified.

1.5 Certain airtime plans may only be available for services supplied with equipment purchased from or approved by Satellite Phone Warehouse.

2. Minimum Term

2.1 The minimum term applicable to your service is specified in your Airtime Service Agreement.

2.2 The minimum term commences on the date the service is activated.

2.3 If a service is cancelled before the expiry of the minimum term, any remaining monthly access fees for the balance of the minimum term may become immediately due and payable.

2.4 Upon expiry of the minimum term, the service will continue on a month-to-month basis until disconnected in accordance with Section 7 of these Terms and Conditions.

2.5 Monthly access fees, usage charges and any other applicable fees will continue to be charged until the service has been successfully disconnected.

3. Charges and Billing

3.1 You agree to pay all monthly access fees, usage charges, administration fees and any other charges associated with your service.

3.2 Usage charges may include, but are not limited to:

• Voice calls
• SMS messages
• Data usage
• Voicemail services
• International calls
• Calls to other satellite networks
• Network-specific charges

3.3 All prices are in Australian Dollars and are inclusive of GST unless otherwise stated.

3.4 Invoices must be paid by the due date shown on the invoice.

3.5 You authorise Satellite Phone Warehouse to charge your nominated payment method for all amounts owing under your account.

3.6 The Customer is responsible for ensuring that their nominated payment method remains valid and current. Failure to provide updated payment details may result in suspension or disconnection of the service.

3.7 If a payment is declined, dishonoured or remains unpaid after the due date, we may suspend or restrict the service without notice.

3.8 Interest may be charged on overdue amounts at a reasonable rate permitted by law.

3.9 Where an account remains unpaid, Satellite Phone Warehouse may refer the debt to a third-party debt collection agency or legal representative for recovery.

3.10 You agree to pay all reasonable costs incurred by Satellite Phone Warehouse in recovering overdue amounts, including but not limited to debt collection agency fees, legal costs, court filing fees, tracing fees and other recovery expenses permitted by law.

4. Usage Responsibility

4.1 You are solely responsible for all usage incurred on your service.

4.2 You are responsible for monitoring service usage and associated charges.

4.3 Satellite Phone Warehouse is not required to monitor usage levels or notify you when usage reaches a particular value, limit or cost.

4.4 All charges incurred on the service remain payable regardless of whether the usage was authorised by you or another person with access to the service.

4.5 Satellite Phone Warehouse is not responsible for charges incurred as a result of network provider billing errors, roaming activity, device misuse, theft or unauthorised use of the service.

5. Pricing Changes

5.1 We may vary pricing where required by our suppliers, network providers or operating costs.

5.2 Where practical, we will provide reasonable notice of any material pricing changes.

5.3 Requests to change airtime plans may be subject to approval by the applicable network provider and may result in a new minimum term, revised pricing or additional charges.

6. Suspension and Termination

6.1 We may suspend or terminate your service if:

a) payment remains overdue;

b) you breach these Terms and Conditions;

c) the service is withdrawn by the network provider;

d) we reasonably believe the service is being used unlawfully; or

e) circumstances beyond our control prevent us from supplying the service.

6.2 Suspension or termination of the service does not remove your obligation to pay outstanding charges.

6.3 Any outstanding balance remains payable following termination of the service.

6.4 Where an account remains unpaid, Satellite Phone Warehouse may suspend or disconnect the service without further notice. Reconnection may incur additional fees and may require payment of all outstanding amounts before the service is restored.

7. Cancellation and Disconnection

7.1 Requests to cancel or disconnect a service must be submitted in writing by the account holder or an authorised representative.

7.2 Disconnection requests must be emailed to sales@satellitephonewarehouse.com.au.

7.3 Disconnection requests must include:

a) the service number to be disconnected; and

b) the requested disconnection date.

7.4 Disconnection requests must be received during normal business hours (Monday to Friday, excluding public holidays).

7.5 To avoid charges for the following month, disconnection requests must be received before the last business day of the current month. This allows sufficient time for Satellite Phone Warehouse to process the request and arrange disconnection with the network provider.

7.6 Cancellation requests are not effective until acknowledged by Satellite Phone Warehouse.

7.7 Requests received outside business hours, on weekends, public holidays, or after the last business day of the month may not be processed until the following month and may result in an additional month's access fees and charges being payable.

7.8 Services continue to be billed until the service has been successfully disconnected by the network provider.

7.9 Satellite Phone Warehouse is not responsible for delays in disconnection caused by the network provider or circumstances outside our control.

7.10 The Customer remains responsible for all charges incurred up to and including the date of disconnection.

7.11 Where a minimum term applies, early termination charges may apply if the service is cancelled before the expiry of the minimum term.

7.12 Reconnection of a disconnected service may incur reconnection fees and network provider charges.

7.13 Requests to suspend a service are subject to the rules, availability and approval of the applicable network provider and may not be available on all plans.

7.14 Where available, service suspensions do not terminate the service agreement and may be subject to minimum suspension periods, suspension fees, network provider requirements and ongoing monthly charges.

8. Service Availability

8.1 Satellite services are supplied using third-party satellite networks and infrastructure.

8.2 Coverage, performance and availability are dependent on factors including location, weather conditions, equipment, satellite network availability and circumstances outside our control.

8.3 We do not guarantee uninterrupted, error-free or continuous service.

8.4 Service interruptions, outages and maintenance events may occur from time to time.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, Satellite Phone Warehouse is not liable for any indirect, incidental, special, consequential or economic loss arising from the use of, or inability to use, the service.

9.2 Our liability for any claim relating to the service is limited to the resupply of the service or the cost of resupplying the service.

9.3 Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

10. Privacy

10.1 We may collect, store and use personal information for the purpose of providing and administering services.

10.2 Personal information may be disclosed to network providers, payment processors and service providers where necessary to provide the service.

10.3 We will handle personal information in accordance with applicable Australian privacy laws.

11. Changes to These Terms

11.1 We may amend these Terms and Conditions from time to time.

11.2 The latest version will always be available on our website.

11.3 Continued use of the service after any amendment constitutes acceptance of the updated Terms and Conditions.

12. Governing Law

12.1 These Terms and Conditions are governed by the laws of Western Australia.

12.2 The parties submit to the non-exclusive jurisdiction of the courts of Western Australia.
